On a first-time DWI, a person’s license can be suspended for 90 days or for 180 days if the person refuses the blood or breath test. If the person’s blood alcohol was measured at .15 or greater, the court can require an ignition interlock as a condition of reinstating driving privileges. On a second DWI offense, license suspension is six months (or one year for refusal). Subsequent offenses result in revocation for a year or more.

The license revocation hearing is a separate administrative process. You can win your ALR hearing even if you are convicted of DWI, and you can lose your driving privileges even if your DWI case ends in dismissal or acquittal. On a repeat DWI, however, you are subject to a mandatory conviction suspension as well as the administrative suspension.

In an ALR hearing, there is a lower burden of proof than in criminal court. However, you have a right to call witnesses and cross-examine the arresting officer. Attorney Larry P.
